Product or Service-Based Terms
These Product or Service-Based Terms ("Terms") govern the specific nature, limitations, and responsibilities related to individual services and platforms developed or offered by Equafusion ("we," "us," or "our"). These Terms are applicable in conjunction with our main Terms of Use and Privacy Policy. All users agree to these Terms when opting to engage in our services, whether for personal, commercial, or enterprise use.
1. E-Commerce Websites
Platform Development Only
Equafusion builds and delivers the technical infrastructure for e-commerce platforms based on client requirements. This includes setting up the website, integrating design, product listing frameworks, admin dashboards, and other automation systems as per your custom workflow.
Taxes
All applicable local, state, national, or international taxes related to the operation of your e-commerce store are the sole responsibility of the client. Equafusion neither calculates nor remits any taxes unless explicitly contracted to do so. This includes GST, VAT, sales tax, customs duties, and import/export levies. Clients must also comply with their local tax authority's invoicing and documentation requirements.
Payment Gateways
Integration with payment gateways (e.g., Razorpay, Stripe, PayPal, Square) will be implemented as per client preference. Equafusion is not responsible for transaction success, failure rates, fraud protection, chargebacks, payout delays, gateway downtime, or any dispute arising between client and the payment processor.
Shipping & Logistics
Unless a logistics management module is specifically developed by Equafusion under contract, the client is fully responsible for shipping, tracking, inventory, return handling, and delivery coordination. Equafusion is not liable for any delivery delays, lost parcels, return fraud, or disputes related to courier or logistics partners.
Customer Support
Equafusion does not provide buyer-side customer support unless separately contracted. Clients are responsible for customer queries, complaints, refunds, and pre/post-sales communications.
Product & Service Claims
Equafusion has no role in the accuracy, legality, or authenticity of products or services sold via your platform. Any product claim, defect, service issue, or legal complaint is solely the client’s responsibility.
2. Domain Name Registration
Third-Party Registration
Domains purchased through Equafusion are procured via third-party registrars such as Dynadot, GoDaddy, Hostinger, OVI Hosting, One.com, and other ICANN-accredited providers. Equafusion acts as an intermediary for domain acquisition.
Ownership & Management
Legal ownership of the domain lies with the client. Equafusion facilitates the purchase but does not assume responsibility for renewal failures, DNS misconfiguration, blacklisting, or domain loss unless a specific domain management contract is signed.
Disputes
Trademark violations, legal notices, or ICANN complaints are the sole responsibility of the client.
3. Email Services
We configure business-grade email addresses using platforms like Zoho Mail, Google Workspace, Outlook365, etc.
Limitations
We provide technical setup only. Deliverability, uptime, storage, spam, phishing, or data loss issues must be handled with the service provider. Equafusion is not responsible for breach of terms, blacklisting, or misuse of email accounts.
4. Email Marketing
Equafusion may configure tools like Mailchimp, ConvertKit, SendinBlue, etc.
Compliance
Clients must comply with local and international spam and privacy laws (e.g., CAN-SPAM, GDPR, CASL). Equafusion disclaims responsibility for policy violations or blacklisted domains resulting from your campaigns.
5. Google Workspace and Other SaaS
We help onboard tools such as Google Workspace, Slack, Notion, ClickUp, etc.
Access & Billing
Accounts are managed by the client. Equafusion does not retain administrative access unless agreed. Billing, user control, and internal policies remain the client’s responsibility.
6. Portfolio Websites
We develop static/dynamic personal or business portfolios. Content accuracy and rights are the client’s obligation. Any future update post-delivery requires a maintenance agreement.
7. Ticket Booking Websites
Used for concerts, events, or appointments.
Fulfillment
Equafusion is not liable for no-shows, cancellations, ticket fraud, refunds, event permits, or local licensing.
8. Scheduling Websites
We integrate services like Calendly, TidyCal, Google Calendar, etc.
Limitations
Equafusion is not responsible for syncing errors, time zone mismatches, booking overlaps, or client-end unavailability.
9. Business Websites
General corporate, landing page, and lead capture websites are built.
Content Responsibility
Content must be legally compliant, authentic, and original. Clients hold full accountability for false claims, promotional content, or misleading information.
10. Donation Websites
Equafusion builds donation pages and portals in two modes:
Type 1: Client-Owned Infrastructure
If the client uses their own domain, payment gateway, and hosting, Equafusion's role is limited to designing and deploying the donation website. Equafusion is not responsible for compliance, financial handling, legal risks, or disputes.
Type 2: Equafusion-Owned Infrastructure
If the client uses donation services on Equafusion's own domain or subdomain (or premium plans allowing custom domains managed by Equafusion), Equafusion will handle the end-to-end setup and technical operations. However, Equafusion’s responsibility remains limited to website infrastructure and does not extend to legal compliance, taxation, fund usage, or any form of misrepresentation. A small processing or infrastructure maintenance fee may be charged by Equafusion.
Payment Processing
All donations are processed via third-party gateways. Equafusion holds no role or liability for delays, transaction failures, gateway terms, fees, or dispute resolutions.
11. Link-in-Bio Pages
Custom single-page link profiles for influencers or brands.
Hosting
These may be hosted via third-party CMS or platforms. Equafusion does not control downtime or external tool outages.
12. API & Automation
We develop API-based automation tools using services like WhatsApp Cloud API, Telegram Bots, Zapier, Integromat, etc.
Downtime & Dependency
Equafusion does not guarantee uptime or feature continuity of third-party APIs. You bear all risks and charges from such dependencies.
13. Hosting Services
Hosting is provided via third parties like AWS, Google Cloud, Hostinger, etc.
No Ownership
Equafusion acts only as a facilitator. We do not manage server security patches or data backups unless specified in writing.
14. Website Maintenance & Security
Security patches, plugin updates, backups, and content changes are not included post-handover unless a service plan is purchased.
15. Content Management
Clients are responsible for uploading and managing content unless contracted otherwise. Equafusion does not verify the legality or accuracy of any uploaded file, text, or image.
16. Payment Processors
Payment gateways are third-party owned. Their fraud management, downtime, currency conversion, and settlement timelines are outside Equafusion’s control.
17. SMS & Communication
Equafusion integrates SMS/email marketing via providers like Twilio, MSG91, Mailgun, etc.
Responsibility
Clients must use these tools legally and ethically. Equafusion disclaims responsibility for spam, blacklisting, or consumer complaints.
18. Service Disclaimers
Equafusion is not an e-commerce seller, merchant, payment provider, logistics agent, or tax advisor.
We are only responsible for technical design and development.
Legal, financial, or operational consulting is not included unless stated.
19. Liability
We shall not be liable for indirect, incidental, or consequential damages from service use. Your usage of the developed platform is at your own risk.
20. Post-Launch Changes
Any future edits, security updates, SEO changes, plugin renewals, or service tweaks must be covered under a paid maintenance plan.
These product or service-based terms are subject to regular revision. Please check periodically. Your continued use constitutes acceptance of any changes.
